MDC national vice-chairperson and Zengeza West MP Job Sikhala has been acquitted of plotting to overthrow President Emmerson Mnangagwa by the High Court. Sikhala was acquitted by Masvingo High Court Judge Justice Garainesu Mawadze.
Sikhala was arrested in July last year. He was charged with subverting a constitutional government as defined in section 22(2)(a)(iii) of the Criminal Law (Codification&Reform) Act for allegedly advocating for the overthrowing of a government through unconstitutional means.
The charges came after Sikhala told a rally in Bikita, Masvingo province that the opposition MDC Alliance party will stage a mega-demonstration that will bring down the government.
Said Sikhala:
This did not go down well with the authorities who promptly arrested him and charged him with treason.
However, Sikhala’s lawyer, Beatrice Mtetwa of the Zimbabwe Lawyers for Human Rights (ZLHR) filed an application for exception arguing that according to the constitution the accused’s utterances did not constitute a crime.
Justice Mawadze agreed with this assessment and described as “bizarre” the allegation that Sikhala wanted to stage a coup against President Emmerson Mnangagwa.
Justice Mawadze said that politicians should be allowed to be politicians. He added that there was nothing wrong with what Sikhala had said and found him not guilty of the treason charges.
