Dayton man requests to withdraw guilty plea in child porn case

DAYTON — A Dayton man who previously pleaded guilty to child porn charges has asked to withdraw his plea.

Jeff McDonald, 63, was convicted of 10 counts of pandering obscenity involving a minor (create, reproduce, publish) after pleading guilty in December, according to court records.

Multiple charges against McDonald were dismissed, including:

• 7 counts of pandering obscenity involving a minor (create, reproduce, publish)
• 2 counts of pandering sexual oriented material involving minor (create material)
• 4 counts of pandering sexual oriented material involving minor (solicit-possess material)
• 1 count of illegal use of minor in nudity oriented material or performance

He was set to be sentenced Thursday after the sentencing hearing was rescheduled multiple times. But now he will not be back in court until April 17, when a judge will determine whether to accept McDonald’s request to withdraw the plea.

On June 11, 2018, Kettering police responded to a call about a memory card with child pornography, according to police.

McDonald was reportedly identified as the owner of the memory. Because he is a Dayton resident, Dayton police were contacted.

An investigation into the memory card and McDonald’s cell phone reveal multiple images and videos of child pornography, according to the Montgomery County Prosecutor’s Office.
