Supreme Court Issues Notice to J&K Admin on Plea by Omar Abdullah's Sister Against His Detention

A plea was filed by Sara Abdullah Pilot, former CM Omar Abdullah’s sister and wife of Rajasthan Deputy Chief Minister Sachin Pilot, challenging his detention custody under J&K Public Safety Act.

New Delhi: The Supreme Court on Friday issued a notice to the Jammu and Kashmir administration seeking validity of the detention centre where former Chief Minister Omar Abdullah has been under the Public Safety Act (PSA), 1978. The top court has asked the authorities to file a reply by March 2, the next date when it will hear the case.

A two-judge bench of Justice Arun Mishra and Justice Indra Banerjee heard the plea which was filed by Sara Abdullah Pilot, former CM Omar Abdullah’s sister and wife of Rajasthan Deputy Chief Minister Sachin Pilot, challenging his detention custody under J&K Public Safety Act.

Omar’s sister called the February 6 order under PSA “unconstitutional and a flagrant violation of fundamental right”.

The National Conference leader had been under preventive detention since August 5 last year, when the Centre announced the abrogation of Article 370 of the Constitution granting a special status and bifurcation of the erstwhile state into two union territories — Ladakh, and Jammu and Kashmir. He was again booked under the PSA on the night of February 6, just a few hours before his preventive detention was to end.

“We were hopeful that, as this is a habeas corpus case, that the relief would be sooner. But we have full faith in the justice system. We’re here because we want that all Kashmiris should have the same rights as all citizens of India and we’re waiting for that day,” said Sara Abdullah Pilot after the hearing.

The hearing for the case was earlier supposed to have been held on February 13 but could not happen as senior advocate Kapil Sibal, appearing for Sara, informed the court that he would not be available for the hearing. Thus, the top court scheduled the matter for hearing on Friday.
